Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the www.boloclean.com website (the "Service") operated by Bolo Clean Inc ("us", "we", or "our").
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to use the website and access the Service.

Purchases/ Payment and Payment Disputes

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
The service may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.
We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.
We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

THE DOWN PAYMENT IS NORMALLY 10 PERCENT OF THE CONTRACT/SERVICE PRICE.

Client agrees to pay for the entire project as well as the New York state tax rate of 8.87%. Payment for contracting services will be distributed at the following time points of the project:
I. Prior to the start of the project: 10% of the total payment is due. This is due immediately after the client signs the contract.
II. Midway through the project: 60% of the total payment is due.
III. Conclusion of the project: 30% of total payment is due.
Invoices not paid within 15 days after the completion of the project will result in additional interest charges. Bolo Clean Inc. retains the rights to charge additional fees or interest for Non Payment or Late Payment. Customers have all rights to complain if he or she is not satisfied with the project within the appropriate complaint period. DURING THE COMPLAINT PERIOD, YOU HAVE THE RIGHT TO MAKE A WRITTEN COMPLAINT REGARDING THE SERVICES UNDER THE SATISFACTION GUARANTEE, AND WE WILL ATTEMPT TO ASSIST YOU IN RESOLVING THE ISSUE. SINCE SERVICE IS SUBJECTIVE, WE DO NOT PROVIDE ANY REFUND OR CREDIT.
You agree to not make any payments to our CONTRATORS or SUBCONTRATORS or hire our CONTRATORS or SUBCONTRATORS for the current project.

Please note that in the event you dispute any part of the service fee via chargeback, or refuse to issue full payment after completion of the project, Bolo Clean, Inc. has the right to pursue all legal options for our payment, and to seek reimbursement of any related costs incurred by us, to turn any past due accounts over to collections and/or report delinquent payments to credit bureaus. If the customer account is referred to a collection agency or attorney for collection, attorney’s fees and costs of collection shall be recoverable by Bolo Clean Inc.

Price Adjustments. There will be no price adjustments for services after the contract has been signed unless the customer requests additional services, at which, Bolo Clean Inc. reserves all rights to create an amendment to the contract. All services provided are defined in the attached work order. The work and specifications described in the contract are incorporated as a sales agreement and the specifications describe the work to be performed to the best of Bolo Clean Inc.’s ability. ONLY THE ITEMS SPECIFIED BY SIGNATURES, INITIALS AND CHECK MARKS WRITTEN ON THIS AGREEMENT WILL BE PERFORMED. IF CLIENT REQUESTS ADDITIONAL WORK, THIS WILL RESULT IN ADDITIONAL COSTS. ADDITIONAL REQUESTS WILL BE ADDED TO THE ORIGINAL CONTRACT VIA AN AMENDMENT. CUSTOMER SHOULD NOT ACCEPT VERBAL ASSURANCES FROM ANY REPRESENTATIVE OF BOLO CLEAN INC. Additional services may be performed at the request (Regardless it is oral or written request) of the Client and will be subject to additional charges with or without the client signature. We are not responsible for any items that are broken/missing. If the customer is not available for the initial walkthrough or when the job is being performed, the job site supervisor will proceed with the work to the best of his/her understanding from the work. Bolo Clean Inc. is not responsible for any problems that arise from the client not being available and physically present.

Insurance

Contractor will carry appropriate insurance and shall provide a Certificate of Insurance to the client upon the client’s request.

Availability, Errors and Inaccuracies
We are constantly updating product and service offerings on the Service. We may experience delays in updating information on the Service and in our advertising on other web sites. The information found on the Service may contain errors or inaccuracies and may not be complete or current. Products or services may be mispriced, described inaccurately, or unavailable on the Service and we cannot guarantee the accuracy or completeness of any information found on the Service.
We therefore reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
Contests, Sweepstakes and Promotions
Any contests, sweepstakes or other promotions (collectively, "Promotions") made available through the Service may be governed by rules that are separate from these Terms Conditions. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms and Conditions, the Promotion rules will apply.

Accounts

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.
You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

The Service and its original content, features and functionality are and will remain the exclusive property of Bolo Clean Inc and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Bolo Clean Inc.

Our Service may contain links to third party web sites or services that are not owned or controlled by Bolo Clean Inc.
Bolo Clean Inc. has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.
You acknowledge and agree that Bolo Clean Inc shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third party web sites or services that you visit.

Disclaimer of Representations or Warranties

BOLO CLEAN DOES NOT MAKE ANY WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF NON-INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED.”

“YOUR SOLE REMEDY UNDER THE SATISFACTION GUARANTEE IS PERFORMANCE OF ADDITIONAL SERVICES TO CORRECT ANY DEFICIENCIES IN ANY SERVICES PROVIDED, AS PROVIDED IN THE GUARANTEE. BOLO CLEAN INC. MAKES NO OTHER REPRESENTATION, WARRANTY, OR GUARANTY AS TO THE RELIABILITY, SAFETY, TIMELINESS, QUALITY, SUITABILITY OR AVAILABILITY OF ANY SERVICES, PRODUCTS OR SUPPLIES OBTAINED BY OR FROM THIRD PARTIES. YOU ACKNOWLEDGE AND AGREE THAT THE ENTIRE RISK ARISING OUT OF YOUR USE OF BOLOCLEAN.COM AND SERVICES AND OR THIRD PARTY SUPPLIES REMAINS SOLELY WITH YOU, TO THE MAXIMUM EXTENT PERMITTED BY LAW."

Publicity

Bolo Clean Inc. reserves the right to, and you explicitly permit Bolo Clean Inc. to, take photos and recordings of the work done on your property and such photos or recordings will be reproduced and displayed online and in various marketing materials. (Including the right to permit our designees to use all images and recordings). By using our website and by contacting us, you agree and permit Bolo Clean Inc. (or its designee/contractor/subcontractors) with reasonable access to the project site for such purpose, and that you agree that Bolo Clean Inc. may disclose, copy, reproduce, publicly display, publicly perform, transmit, distribute, translate, reformat, incorporate, and otherwise use such photos and recordings, along with your name, voice, likeness and other information, content, or materials embodied therein, in whole or in part, and create derivative works therefrom, in any media now known or hereafter developed, and for any and all commercial or non-commercial purposes without compensation or acknowledgement to you or anyone else.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Termination of Agreement for Contract Cleaning. In the event that this Agreement proves unsatisfactory, a 30-day written notice by either party may terminate the Agreement. If the Client terminates without notice, the Client will be billed for the entire month’s services. Bolo Clean may terminate the Agreement at any time without notice for nonpayment of services.

NOTICE OF CANCELLATION

According to New York City Home Improvement Law, “YOU, THE BUYER, MAY CANCEL THIS TRANSACTION AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DATE OF THIS TRANSACTION”.

MAY CANCEL THIS TRANSACTION, WITHOUT ANY PENALTY OR OBLIGATION, WITHIN THREE BUSINESS DAYS FROM THE ABOVE DATE. IF YOU CANCEL, ANY PROPERTY TRADED IN, ANY PAYMENTS MADE BY YOU UNDER THE CONTRACT OR SALE, AND ANY NEGOTIABLE INSTRUMENT EXECUTED BY YOU WILL BE RETURNED WITHIN 10 BUSINESS DAYS FOLLOWING RECEIPT BY THE SELLER OF YOUR CANCELLATION NOTICE, AND ANY SECURITY INTEREST ARISING OUT OF THE TRANSACTION WILL BE CANCELLED. IF YOU CANCEL, YOU MUST MAKE AVAILABLE TO SELLER AT YOUR RESIDENCE, IN SUBSTANTIALLY AS GOOD CONDITION AS WHEN RECEIVED, ANY GOODS DELIVERED TO YOU UNDER THIS CONTRACT OR SALE; OR YOU MAY, IF YOU WISH, COMPLY WITH THE INSTRUCTIONS OF THE SELLER REGARDING THE RETURN SHIPMENT OF THE GOODS AT THE SELLER’S EXPENSE AND RISK. IF YOU DO MAKE THE GOODS AVAILABLE TO THE SELLER AND THE SELLER DOES NOT PICK THEM UP WITHIN 20 DAYS OF THE DATE OF YOUR NOTICE OF CANCELLATION, YOU MAY RETAIN OR DISPOSE OF THE GOODS WITHOUT ANY FURTHER OBLIGATION. IF YOU FAIL TO MAKE THE GOODS AVAILABLE TO THE SELLER, OR IF YOU AGREE TO RETURN THE GOODS TO THE SELLER AND FAIL TO DO SO, THEN YOU REMAIN LIABLE FOR PERFORMANCE OF ALL OBLIGATIONS UNDER THE CONTRACT. TO CANCEL THIS TRANSACTION, MAIL OR DELIVER A SIGNED AND DATED COPY OF THIS CANCELLATION NOTICE OR ANY OTHER WRITTEN NOTICE, OR SEND A TELEGRAM, TO Bolo Clean Inc. AT P O Box 100833 Brooklyn New York 11210 NOT LATER THAN MIDNIGHT OF the date you sign the contract or service terms and agreements.
You acknowledge that notice has been given as part of the User Terms. You agree entirely that Bolo Clean Inc. has given you notice of your right to cancel the service Contract. You can also send the notice of cancellation to Bolo Clean at Info@boloclean.com.

Satisfaction Guarantee

Generally speaking, services are subjective, which is why Bolo Clean, Inc, cannot offer refunds once we have started or after completion of the project. Nevertheless, we do offer a 100% satisfaction guarantee. Our 100% satisfaction guarantee means that we will continue to work to accommodate you, including organizing extra services to correct any defective or deficient work, until you are 100% satisfied with the outcome of the project. If Bolo Clean, Inc. did not complete the service contract to the customer’s satisfaction, customers have all rights to inform us within 3 calendar days of the completion date of the project. Under no circumstances will customers receive refunds or credits be provided once the projects have started or completed.

Schedule

The commencement of work under the Contract occurs when the CONTRACTORS OR SUBCONTRACTORS begins performance of the service. The approximate start and completion dates are identified in the contract. Customers agree not to hold Bolo Clean, Inc. reliable for not completing the project or services on the date identified in the contract.

Governing Law

These Terms shall be governed and construed in accordance with the laws of New York, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service or boloclean.com.

Liability Disclaimer/Indemnification
